By accessing and using the website lucrativemerchants.com (the "Site") and any services offered by Lucrative Merchants ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or services.
Lucrative Merchants is an independent sales organization (ISO) and payment processing consultancy. We act as an intermediary to connect merchants with payment processors, acquiring banks, and point-of-sale system providers. We do not directly process payments, hold merchant funds, or act as a payment processor ourselves. All merchant account agreements are between the merchant and the applicable payment processor or acquiring bank.
Submission of an application through our Site or portal does not guarantee approval for a merchant account. Approval decisions are made solely by the payment processor or acquiring bank to which your application is submitted. Factors including but not limited to credit history, business type, processing history, chargeback ratios, and underwriting criteria determined by the processor affect approval decisions. Lucrative Merchants has no authority to approve or deny merchant account applications.
Processing rates, fees, and pricing information displayed on this Site are estimates and for informational purposes only. Actual rates are determined by the payment processor and may vary based on your business type, processing volume, card mix, risk profile, and other factors. All rate comparisons and savings estimates are approximations based on publicly available information and typical interchange-plus pricing. See our full Rate Disclaimer for details. Lucrative Merchants makes no guarantee that you will achieve any specific savings amount.
As an ISO and payment processing consultant, Lucrative Merchants may receive compensation from payment processors, acquiring banks, and POS system providers when merchants are successfully onboarded. This compensation does not affect the rates offered to merchants — all processor relationships are disclosed and merchants receive the same rates whether referred by LM or applying directly.
All content on this Site, including text, graphics, logos, images, and software, is the property of Lucrative Merchants or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
To the fullest extent permitted by law, Lucrative Merchants, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or services, including but not limited to damages arising from processor decisions, rate changes, account terminations, or processing interruptions. Our total liability to you for any claims arising under these Terms shall not exceed the fees paid by you to Lucrative Merchants in the twelve months preceding the claim.
This Site and our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Our Site may link to or integrate with third-party services including payment processor portals, POS system providers, scheduling tools, and communication platforms. Your use of those services is governed by their own terms and policies. Lucrative Merchants is not responsible for the content, privacy practices, or actions of third-party services.
You agree not to use our Site or services to: submit false or misleading information in any application; engage in any activity that violates applicable laws or regulations; attempt to gain unauthorized access to our systems; transmit any harmful code or malware; or use our services for any unlawful business activity.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Snohomish County, Washington.
We reserve the right to modify these Terms at any time. We will update the "Last updated" date above when changes are made. Your continued use of our Site after changes are posted constitutes acceptance of the modified Terms.
